Inheritance Law

Legal assistance in probate proceedings, disputes between heirs, and the regulation of inheritance relations.

Inheritance documentation prepared for legal analysis.

Inheritance matters often involve complex property and family issues that require a thorough analysis of the documentation and the legal position of each heir.

We provide support in probate proceedings, inheritance disputes, and advance estate planning through wills and inheritance agreements.

Probate usually comes at a time of loss, when the family has the least energy for paperwork. We take on part of that burden: we explain what is needed, obtain the documents and keep track of deadlines.

Areas of Practice

  • Probate proceedings
  • Drafting wills
  • Lifetime support agreements
  • Agreements on the transfer and distribution of property
  • Establishment of inheritance rights
  • Contesting a will
  • Disputes between heirs

How we approach your matter

We help heirs understand the statutory order of succession, the effect of a will and the options available to them: accepting, renouncing or assigning an inheritance. Where possible, we propose an agreement on division within the probate proceedings.

When heirs disagree, for example about the validity of a will, the extent of the estate or the forced share, we represent you in litigation and protect your share of the inheritance.

How we work together

  • Documents: we obtain certificates, property records and the other papers required.
  • Opening: we open the probate proceedings before the court or a notary.
  • Hearing: we represent you at the hearing and propose an agreement between heirs.
  • Registration: after the decision, we follow registration of rights in the cadastre and other registers.

Worth knowing

A will only takes legal effect if it is made in the prescribed form. Even where there is a will, the closest relatives may be entitled to a forced share, which is worth discussing before the will is drawn up.

A carefully settled estate preserves both the property and the family's relationships.
